1. Acceptance of Terms

FotoRipple is a service provided by Larga Trading Limited trading as FotoRipple ("the Company," "we," "our," "us"). By accessing and using FotoRipple ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

FotoRipple is an AI-powered service that transforms static photographs into animated video clips. The Service includes:

• Photo upload and processing capabilities
• AI-powered image enhancement and colorization
• Video clip generation from static images
• Video compilation with background music
• Project organization and management tools

3. User Accounts and Authentication

To use the Service, you must create an account using OAuth authentication through Google or Facebook. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

4. Credit System and Billing

FotoRipple operates on a credit-based system:

• New users receive 5.00 welcome credits upon account creation
• Video clip generation costs 1.00 credit per clip
• Photo enhancement and variant creation are currently free
• Credits can be purchased through Stripe payment processing
• Promo codes may be available for additional credits
• Credits are non-refundable and non-transferable
• Unused credits do not expire

5. Content Policy and User Conduct

You agree not to upload, create, or share content that:

• Violates any applicable laws or regulations
• Infringes on intellectual property rights of others
• Contains explicit, adult, or inappropriate material
• Promotes violence, hatred, or discrimination
• Contains malicious software or harmful code
• Violates the privacy rights of others

We reserve the right to remove content that violates our content policy and may result in account suspension or termination.

6. Intellectual Property Rights

You retain ownership of the original photos you upload to the Service. By using the Service, you grant us a limited, non-exclusive license to:

• Process and store your photos for the purpose of providing the Service
• Create video clips and enhancements as requested by you
• Use anonymized, aggregated data for service improvement

The AI-generated videos created by the Service are owned by you, subject to our underlying intellectual property rights in the Service itself.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

8. Service Availability and Modifications

We strive to provide reliable service availability, but we do not guarantee:

• Uninterrupted or error-free operation of the Service
• Specific processing times for AI-generated content
• Permanent storage of your content beyond reasonable periods

We reserve the right to modify, suspend, or discontinue the Service with reasonable notice to users.

9. Limitation of Liability

To the maximum extent permitted by law, Larga Trading Limited trading as FotoRipple shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

10. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the Service will cease immediately
• Your content may be deleted from our servers
• Unused credits will be forfeited
• Provisions that should survive termination will continue to apply

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified terms.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of New Zealand, where Larga Trading Limited is incorporated, without regard to conflict of law principles.
